General

Niutclub.se is operated by Niut AB (organization number: 559328-9340). The purchase conditions apply to all purchases made on Niutclub.se and Niutclub.com. For questions, contact us at info(a)niutclub.com, and we usually respond within 1 working day.


Order

When you complete an order at checkout, an agreement is made between you and Niut AB. An order confirmation is sent to the email address you have registered. Niut reserves the right to correct placed and confirmed orders due to typographical errors and similar mistakes. Niut does not accept purchases made by minors.


Prices

All prices at Niut AB are stated including VAT. The total price, along with applicable shipping costs, is indicated in the shopping cart before you complete the purchase. We reserve the right for possible typographical errors, product changes, price adjustments, and possible color deviations. We reserve the right to adjust obvious printing errors regarding the price before and after the order has been processed.


Deliveries


Delivery Time

Delivery times may vary among different products. More information about the delivery time for each product can be found on the individual product page. All products in an order are shipped from our warehouse, hence the product with the longest stated delivery time is the most indicative of the delivery time for the entire order. Please note that delivery times on the website are preliminary. For in-stock items, the delivery time is 1-3 working days. For items on order, the delivery time is usually 1-2 weeks but can in some cases be up to 12-16 weeks. In case of delivery delays, you will be contacted by Niut AB. If Niut AB cannot remedy the error within a reasonable time, you as a consumer also have the right to cancel the purchase.


Delivery Method

Delivery notification is made via the transport company to the phone number you have registered with Niut AB.


Delivery Cost

Possible delivery costs are stated at checkout. The stated delivery cost does not apply to deliveries to islands without a bridge connection or other places lacking a drivable road. In such cases, Niut reserves the right to unilaterally change the delivery cost, delivery time, and method of delivery. However, you will be contacted before the delivery starts.

Error in Delivery

If damage is visible on the packaging, it should be noted on the consignment note before you receive the package. If an error occurs upon delivery, contact the transport company first. If they cannot help you, we will! Read more about transport damage under point 10.


Uncollected Package

Uncollected packages are charged with a fee to cover the freight costs that an uncollected package entails. The fee amounts to 199 SEK per package. Your package is normally kept at the agent for 14 days before it is returned to our warehouse.

Change of Delivery Address

If your order has not yet been shipped, we can change the delivery address you have 

specified without any problems. If your order has already been shipped from our warehouse, we will charge you an administrative fee of 299 SEK to change your delivery address afterwards. Therefore, make sure you enter the correct delivery address when placing your order and carefully check your order confirmation.


Price and Product Information

In the event of inaccuracies in stock status or price, Niut reserves the right to cancel the purchase agreement. If an item has been discontinued or for another reason is not available, Niut is not obligated to provide the item but may suggest an alternative item. We always do our utmost to present the goods as realistically and correctly as possible on the site, but we cannot guarantee that your screen reproduces color and size correctly. Product facts and price information are subject to typographical errors, suppliers' price increases, inventory management, any incorrectly stated specifications, etc. Pictures should be seen as illustrations and cannot be guaranteed to reproduce the exact appearance and/or nature of the item.



Payment


Card Payment

Today, you can choose to pay for your goods at Niut AB with VISA or Mastercard. It is free to pay with a debit card, and Klarna protects your information. Klarna is a Swedish company that handles online verification of credit cards securely, quickly, and easily. When you enter your card details, the account number is encrypted directly. The communication to the Klarna server goes through an encrypted direct connection (https). When your information is then sent to the bank, the bank's security system is used. Klarna uses the strongest encryption available on the market, guaranteeing the highest security. Klarna also meets the requirements for the market's leading security standard PCI DSS and holds an SSL certificate.


Invoice Payment

Through Klarna, we offer you the option to pay for your order via invoice. A quick credit check is performed in conjunction with your order, and you will immediately be informed if you have been approved. Please ensure that you enter the correct address and postal code to get your invoice purchase approved. The payment period is 14 days.


Installment Payment

In collaboration with Klarna, we can offer you the option to split your payment. There are several options to choose from, and you can select the one that suits you best. Of course, you can pay off the remaining debt at any time during the installment period. You can have up to 50,000 SEK in your installment payment account.


All purchases made through Klarna's service, Klarna account, are compiled into a monthly account invoice. You apply for installment payment at checkout when making your purchase. In the checkout, you select the "Installment Payment" option and the desired type of installment payment. You will immediately be informed if your application has been approved, and we can immediately process your purchase. If your application is not approved, you can return to the checkout and select an alternative payment method. Klarna will send a credit agreement for you to sign and return in the enclosed reply envelope if your purchase exceeds 1500 SEK. Ensure the information is correct, sign the agreement, and return it.


Gift Cards and Discounts

At Niut, you can purchase gift cards to, for example, give away as gifts. When you buy a gift card from us, you will receive an order confirmation with a discount code that can then be used in our checkout. Should you encounter any problems with your gift card, please contact us for assistance. The validity period for our gift cards is 1 year (counted from the day they were issued).

We occasionally offer specific promotions in the form of discount codes. These discount codes cannot be combined with other offers or items already on sale. If you use a discount code not issued for you, we reserve the right to deny and cancel your purchase after it has gone through, or alternatively charge you for the discounted amount.


Cancellation

For cancellations or changes to your order, please email us at info(a)niutclub.com for assistance!

Items that Niut has begun packaging or delivering and non-stocked items that Niut has begun manufacturing or customizing according to your specifications cannot be canceled without cost. Orders with a delivery time of 1-10 days are processed immediately. Other orders are processed 10 hours from the time you placed your order. If your order is processed as above, you cannot cancel the purchase without incurring an administrative fee.

If the order has already begun to be processed/packed from our warehouse (but not shipped), cancellation is still possible, but an administrative fee of 199 SEK will be added.

For orders where processing has not yet begun, cancellation can take place. In this case, the customer is charged a fee of 99 SEK for the administrative costs incurred due to the cancellation.

If your order has already been shipped from our warehouse, you need to allow the shipment to return automatically. This is done automatically after two weeks if you choose not to pick up the shipment at the agent, or do not book a day and time for home delivery. Within 30 days after the shipment has been returned to us, we will adjust your payment/invoice. Note that the cost for this is 99 SEK for deliveries to agents and 599 SEK for deliveries made with home delivery.

If you have paid by invoice, we recommend that you pay your invoice to avoid late fees. If you instead wish to pause the payment, please contact Klarna for assistance.


Right of Withdrawal and Returns

As a consumer, you have the right to withdraw your purchase without giving any reason within 14 days. The withdrawal period expires 14 days after:


  1. a) in the case of a sales contract, the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods,

  1. b) in the case of a contract relating to multiple goods ordered by you in one order and delivered separately, the day on which you or a third party other than the carrier and indicated by you, acquires physical possession of the last good,

  1. c) in the case of a contract relating to the delivery of a good consisting of multiple lots or pieces, the day on which you or a third party other than the carrier and indicated by you, acquires physical possession of the last lot or piece.

If the withdrawal period expires on a Saturday or public holiday, the period is extended to the following working day.


If you wish to exercise the right of withdrawal, we ask you to notify us by email at info(a)niutclub.com.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. Niut covers most of the return cost, and you as a customer only pay 199 SEK.


If you are purchasing as a business, unfortunately, you are not covered by the right of withdrawal.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding the costs of delivery and any payment fees incurred.

The reimbursement will be made without undue delay, and in any event, not later than 30 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of such reimbursement.

You shall send back the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

If you have waited more than 30 days from receiving your return label to use it, you will receive a refund for your return in the form of a credit note instead of a refund.


Exceptions to the Right of Withdrawal

In accordance with applicable consumer rights and our commitment to maintaining high standards of hygiene and customer protection, the right of withdrawal does not apply to certain types of products. These exceptions include:

Sex toys: Due to the intimate nature of the products and for hygiene reasons, we cannot offer a right of withdrawal for sex toys. This exception applies as soon as the packaging is opened or the seal is removed.


Hygiene products: This includes, but is not limited to, massage oils, lubes and cleaning sprays. The right of withdrawal does not apply when the packaging of the products is opened or the seal is removed.


This policy is in accordance with Swedish legislation aimed at protecting consumers' health and safety.


Complaints and Transport Damages

If you consider your product to be faulty, substandard, or damaged, you have the right to file a complaint about the product according to the Consumer Sales Act (SFS 1990:932). The right to file a complaint lasts for three years, where the first year acts as a warranty year, during which Niut bears the burden of proof. The subsequent two years activate the right to file a complaint, where you as the customer must be able to prove that the defect is original and related to a manufacturing defect. Note that the defect must be reported within a reasonable time. The right to file a complaint only applies to goods purchased by private individuals for private use.


For visible transport damages, the carrier must be informed immediately upon receipt with an addition on the consignment note. Other transport damages must be reported within 24 hours to Niut via email. If this is not followed, the carrier will not accept the complaint, and compensation will be denied. Photograph the delivery, with the damage visible, to facilitate and expedite the process. As a customer, you bear the responsibility to inspect the goods thoroughly and report any defects, damages, or discrepancies before signing any documents.


You as the customer must sign the carrier's consignment note upon delivery, confirming that the delivery was complete, or report any damages. If you are not home at the time of delivery, you have waived your right to file a complaint.


Complaints classified as normal wear and tear will not be approved.

NOTE! The packaging must always be saved in case of a complaint so that the product can be returned to us.


Defective products returned to Niut should be treated as if they were faultless. It is extremely important that the product is packaged in such a way that it does not risk being damaged in all types of returns. Niut reserves the right to replace a defective product with a product of the same model.


Refund

Refunds are made no later than within 30 working days from the day the return is received and processed by Niut. The refund is made using the same payment method as the purchase was made. If you utilize the right of withdrawal, Niut will refund what has been paid for the item. Used freight and any costs to payment companies are not refunded.

If Niut undertakes a re-delivery or rectification of the defect during a complaint, any shipping costs and payment costs will be refunded within 30 days from the day Niut received the complained product.


Privacy Policy

When you register with Niut AB and place an order with us, you agree that Niut AB uses and stores your information to fulfill our commitments to you. Your name, phone number, and address are passed on to the transport company to perform the delivery to you. Niut AB naturally does not give out email addresses, phone numbers, or addresses to others. Your email address and phone number may be used for Niut AB's free newsletter/SMS mailings. You can cancel email and/or SMS mailings at any time. Instructions on how to unsubscribe are provided in the mailing.


Warranties

A one-year warranty applies to goods covered by the Distance Selling Act. Always save your invoice (order confirmation) as it serves as your warranty certificate. All warranty questions must be reported to Niut.

If a fault covered by the warranty ("Warranty Case") exists, Niut AB has the right to choose to inspect or repair the item on-site, replace the whole or part of the item, or refund the purchase price with a reasonable deduction for the benefit you have had from the item. Refund is only given if the item is returned to Niut AB. You bear the cost and risk for such return transport. In the event of a Warranty Case, no other compensation than the aforementioned is provided.

If you have caused or otherwise bear responsibility for the alleged fault, Niut will charge you for the direct costs incurred, e.g., the cost of inspecting the item on-site.

Interest on Late Payment and Reminder Fee

Interest on late payment is charged according to § 6 of the Interest Act (1975:635). Should Niut need to remind you that payment is overdue, a fee of 69 SEK will be charged for the payment reminder.


Limitations of Liability and Force Majeure

If you are a consumer, Niut AB's liability does not cover compensation for loss in business due to delay or defects in the item or, in cases other than those referred to in § 31 of the Consumer Sales Act, compensation for damage to something other than the sold item. If you are not a consumer, Niut AB is not liable for consequential or indirect damage of any kind.

Niut AB's liability under the contract is in all circumstances limited to an amount equivalent to the value of the concerned item. Niut AB's liability for product damage and personal injury is limited to what follows from mandatory legislation.


The following circumstances shall be considered force majeure if they prevent or significantly hinder or delay the performance of the contract. A party is not obligated to take measures to avoid or overcome the consequences thereof: War, strike, riot, mobilization or extensive military call-ups of equivalent scope, natural disaster or extreme weather condition, requisition, seizure, currency restrictions, export or extensive shortage of means of transport, labor conflict including conflict at one's own workplace, fire, new or amended legislation or public regulation or its application, error in or delay of deliveries from subcontractors caused by any of the now stated force majeure reasons, ceased production at subcontractor, and any other circumstance over which the party could not control: provided that the party could not control such circumstance and the impact of the circumstances on the performance of the contract could not be foreseen at the time of the contract's conclusion.


Force Majeure

Niut applies "force majeure," which means that in the event of war, natural disasters, or other unforeseen situations beyond our control, we bear no responsibility for any consequences.


Dispute

If you are a consumer: Dispute arising from this contract shall be adjudicated by Stockholm District Court as the first instance. Swedish law shall apply.

If you are not a consumer: Dispute arising from this contract shall be finally settled by arbitration administered at the Stockholm Chamber of Commerce's Arbitration Institute ("SCC").

If the value of the dispute does not exceed one hundred times the base amount according to the law (1962:381) on general insurance ("The Threshold") at the time of invoking arbitration, the SCC's 

Rules for Simplified Arbitration Procedure shall apply. If the value of the dispute exceeds The Threshold, the Arbitration Rules for the Stockholm Chamber of Commerce's Arbitration Institute shall apply. If the value of the dispute amounts to an amount between The Threshold and 10,000,000 SEK, the arbitral tribunal shall consist of one arbitrator. If the value of the dispute exceeds 10,000,000 SEK, the arbitral tribunal shall consist of three arbitrators. The value of the dispute includes the claimant's claim in the summons application and any counterclaims in the respondent's statement on the summons application.


In the event of a dispute, Niut AB follows the ARN. The seat of arbitration shall be Stockholm.
